If unresolved, disputes shall be referred to arbitration in Lusaka under the rules of the Zambia Association of Arbitrators. The decision of the arbitrator shall be final and binding.
— Jurisdiction and Venue: Subject to the arbitration clause, you agree to submit to the exclusive jurisdiction of the courts of Zambia, with venue in Lusaka, for any permitted legal proceedings.
— Class Action Waiver: To the extent permitted under applicable law, you agree to resolve any disputes with C8 on an individual basis and not as part of a class or collective action.
— Relationship of the Parties: You acknowledge that you and C8 are independent parties. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
— Waiver: Failure by C8 to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
— Severability: If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
— Entire Agreement: These Terms (including the Privacy Policy and any additional terms or guidelines) constitute the complete and exclusive agreement between you and C8 regarding the Services and supersede all prior communications and agreements.
